- In these terms and conditions, the following words (except where the context otherwise requires) shall have the following meanings:
- “Nar-Club” means Yaşar Tezeren – Perle Marketing Personal Company and/or other persons, firms or companies operating duly authorized franchises of Yaşar Tezeren – Perle Marketing Personal Company.
- “Member” means any member of “Nar-Club” or any person or persons seeking or applying to become a member of “Nar-Club” in accordance with the terms and conditions contained herein.
- “Event(s)” means all activities and events organized by “Nar-Club” for members.
- The activities and business purposes of “Nar-Club” are as set out in the Articles of Association of Nar-Club – Perle Pazarlama Şahıs Şirketi.
- Applications for “Nar-Club” membership must be made in writing using the “Nar-Club” application form and signed by the proposed member. If a member joins via internet or telephone, he/she is deemed to have signed the application form. Upon acceptance of membership, the member shall be bound by these terms and conditions and other bylaws and regulations published by “Nar-Club” for the duration of the membership. “Nar-Club” reserves the right to determine the number of members in the Group at any time and at its sole discretion.
- “Nar-Club” reserves the right to expel members at any time or to prevent any member from participating in any event or renewing their membership for any reason.
- Members shall behave in a reasonable, safe and sociable manner while participating in all events towards all other members, the public and any person, firm or company providing instruction or guidance to members in connection with members’ participation in events. Any complaints made to “Nar-Club” regarding the behavior of Members will be handled in accordance with the provisions of Article 4 of this Agreement.
- An active/paid membership is required to book any “Nar-Club” event; the membership must also be active/paid at the time of the event. When booking a vacation, the membership must be active/paid at the time of booking, but not necessarily at the time of travel.
- Members must disclose to “Nar-Club” before participating in any activity any medical condition that may have an impact on the member’s ability to participate in any activity. “Nar-Club” cannot be held responsible if members fail to disclose their medical condition prior to an event and ultimately members must make an informed decision for themselves about each event.
- Members shall equip themselves for events in the manner specified by “Nar-Club” on the internet or in communications with members or as specified by persons, firms or companies engaged by “Nar-Club” to provide instruction and guidance to members. “Nar-Club” shall use its best endeavors to ensure that specialized equipment is provided for the use of members at events requiring such equipment, but “Nar-Club” shall not be liable for any defect or lack thereof or any part thereof at any event in which members participate. Where necessary special equipment is provided, members must at all times use it in accordance with the instructions and must not under any circumstances tamper with or misuse such equipment. “Nar-Club” shall not be held responsible or liable for any member’s failure to use or properly utilize any equipment (specialized or otherwise) provided for the conduct of the events.
- Given the potentially dangerous nature of some events, “Nar-Club” automatically arranges accident insurance coverage for members for events (where available). Details can be obtained from your local office. In addition, members can arrange their own accident insurance through companies of their choice in accordance with their personal circumstances. It is recognized by the “Nar-Club” that members bear full responsibility for taking out (or not taking out, as the case may be) their own accident insurance.
- However, “Nar-Club” will always use its best efforts to eliminate or minimize the risks associated with participation in events.
- For some events, insurance coverage (due to the nature of the event) will not or cannot be provided by “Nar-Club” or members. In such cases, members assume the risk of participating in such events. Participation by members in such events is entirely at the member’s own risk and all such participating members may, at the sole discretion of “Nar-Club” and prior to participating in the relevant event, be required by “Nar-Club” to sign a special waiver form regarding “Nar-Club’s” liability for accident, injury or death to such members, unless such liability is the result of “Nar-Club’s” negligence. Any member who refuses to sign this waiver will be barred from participating in the relevant event (so long as such barring is lawful). In such circumstances, a member who is prevented from attending an event may not be entitled to a refund of any booking fees paid.
- Guests of Members may be required by “Nar-Club”, at its sole discretion, to sign a special waiver form regarding “Nar-Club’s” liability for accidents or injuries to such Guests, whether or not insurance coverage is available for a particular event. Any Guest who refuses to sign such a waiver (if requested to do so by “Nar-Club”) will be prevented from attending the relevant event (so long as such prevention is lawful) and in such circumstances, a guest of a member who is prevented from attending any event may not be entitled to a refund of any booking fees paid.
- Members shall not hold “Nar-Club” responsible or liable in any way for the cancellation of an event for any reason whatsoever. In the event that the cancellation is the fault of an event supplier, “Nar-Club” will use its best efforts to provide a refund of booking fees and other monies paid by the member for such events. In the event that an event is canceled by a member or guest for any reason whatsoever, they are subject to the cancellation policy contained later in these Terms and Conditions and also on the “Nar-Club” website.
- Members booking holiday events:
- In the event that the vacation is booked with a company other than “Nar-Club”, it accepts the booking subject to the terms and conditions of such other company, copies of which “Nar-Club” will provide to members upon request.
- In the event that the holiday activity is booked with “Nar-Club”, the member is deemed to have accepted these and any other terms and conditions made by “Nar-Club” in relation thereto, and members shall in any event agree to the insurance arrangements to be provided to “Nar-Club” by such members prior to the departure date on the holiday activity for which details of travel insurance has been taken out.
- To ensure that the necessary holiday travel insurance is in place and to provide details of such insurance to “Nar-Club” upon request. Members cannot hold “Nar-Club” responsible in any way for failure to make the necessary holiday travel insurance arrangements. “Nar-Club” also recommends that members take out appropriate travel insurance for weekend bookings with “Nar-Club” within Turkey.
- Members’ subscriptions will be as confirmed at the time of joining. Membership, whether monthly, quarterly or annually, is automatically renewed on the anniversary of the start of membership. In the event that any member fails to pay the membership fee in full at any renewal within this period, the membership may be canceled at the discretion of the “Nar-Club” group.
- Direct debit subscriptions will be charged on the 1st, 8th, 15th or 23rd (whichever date is closest to your lunar anniversary), regardless of whether the subscription is taken monthly, quarterly or annually (whichever applies).
- Credit or debit card subscriptions will be charged monthly, quarterly or annually (whichever is applicable) on the anniversary date of the subscription.
- Any free trial membership offer is valid for new members only. Previous members and/or those who have previously taken advantage of this offer are not eligible for this offer.
- The membership of any “Nar-Club” member who attempts to organize an event will be canceled. If any “Nar-Club” member sells or attempts to sell tickets to “Nar-Club” members or other persons to attend an event that is not a “Nar-Club” event, whether such sale, resale or attempted inclusion is made at a “Nar-Club” event or directly or indirectly to “Nar-Club” members, unless the “Nar-Club” member is authorized in writing by “Nar-Club” to undertake any of the aforementioned matters, his/her membership will be revoked at our discretion. No member may advertise any event of any nature whatsoever (including social events) for the benefit of “Nar-Club” members and/or the general public, or use the name of “Nar-Club” that such member wishes to organize.
- Everyone who participates in “Nar-Club” events agrees that they may be filmed or photographed and gives us all rights to use your image (or the people in your group booking) free of charge and may appear in photos or videos. We may publish photos and videos taken by “Nar-Club” staff, our representatives or received from members on our website and in promotional materials on the “Nar-Club” network. It is important for us to share the photos with other members attending events and with new enthusiasts who want to learn a little more about “Nar-Club” and what we do. We will always try to ensure that all photos used are in good taste and not offensive. In addition, members cannot claim any rights over these videos and photos and all similar images, including during the membership process and after leaving the membership, and cannot request their removal or deletion. However, if you see a photo that is inappropriate according to general public ethics or common decency, please contact us with justification and details within 15 days at the latest. In the case of web photos, we will evaluate them as soon as possible and remove them if we deem it necessary, and in the case of printed materials, we will ensure that the photo is not used in subsequent editions.
- Terms and conditions regarding the cancellation of membership and refund of dues are specified in the Membership Cancellation and Refund Terms document.
- “Nar-Club” will contact you via email, text and social media with information about your membership.
- In accordance with the General Data Protection Regulation, please note that by subscribing, whether as part of a promotional offer or for a fee, you consent to “Nar-Club” keeping your personal information on our systems. If you make any request to “Nar-Club” through the website, the information you have entered will be stored in our systems and you will be contacted via e-mail. If you wish to have your information removed from our systems, please contact us by sending an e-mail to contact@perle-marketing.com.
- “Nar-Club” shall have the power to amend these terms and conditions and existing members shall be notified of such amendments within a few days from the date of amendment. When bylaws or minor regulations are made to regulate the conduct and affairs of members, all such bylaws and/or minor regulations shall be published by “Nar-Club” on the “Nar-Club” website and their provisions shall be final and binding on all members.
- “Nar-Club” does not exclude liability for death or personal injury to members or their guests caused by the negligence of “Nar-Club” or its employees or agents (but not subcontractors) and accordingly “Nar-Club” does not exclude any liability of “Nar-Club” under the Unfair Contract Terms Act 1977 and any other statutory limitations.
- These terms and conditions and any other bylaws or minor regulations issued by “Nar-Club” and any other terms and conditions applicable to members contained on the “Nar-Club” website shall be governed by and construed in accordance with Turkish and French Law and shall be subject to the jurisdiction of Turkey and France.
