Introduction
Nar-Club (“Nar-Club”) will endeavor to ensure that the tour operator named on the Nar-Club website offers Nar-Club members the holidays detailed in the Nar-Club holiday information and the tour operator’s brochure (if applicable). Nar-Club members should be aware that many of the holidays offered to Nar-Club members are of a non-traditional nature as an alternative to remote and in some cases underdeveloped parts of the world, lacking the sophistication and amenities found in Western European countries. There is therefore a risk that holidays offered to Nar-Club members may be subject to changes and modifications due to the location of the destination, resulting from local difficulties beyond the control of Nar-Club and the tour operator. Some Nar-Club holidays are arranged through a tour operator with their own booking conditions in their brochure and online. When you book a holiday with Nar-Club, copies of the Nar-Club conditions contained in these conditions and the Tour Operator’s booking conditions displayed online and associated with each holiday are available upon request, unless they conflict with Nar-Club conditions. In the event of any conflict between Nar-Club’s conditions and the Tour Operator’s conditions, Nar-Club’s conditions will apply to your vacation. Nothing in these terms and conditions gives any rights to any third party.
Reservation & Payment
When you book a vacation, you sign a legally binding contract and agree to the terms and conditions set out in this document and the tour operator’s documentation. If certain facilities need to be secured with full payment, your booking deposit may be increased. Once confirmed, the booking deposit, surcharges and insurance premiums will not be refunded in case of cancellation by you. Nar-Club will request full payment if the reservation is made within the payment deadline.
- Online Members booking online are deemed to have seen and accepted the terms and conditions of the tour operator shown on the Nar-Club website. A copy of the operator’s terms and conditions can be provided upon request.
- By telephone: Nar-Club reservation staff will complete your booking and collect the required deposit payment by whatever means you provide. You agree to the terms and conditions of the tour operator shown on the Nar-Club website. A copy of the operator’s terms and conditions can be provided upon request.
- Deposit: Your deposit will be forwarded to the tour operator, corresponding to the full cost of the vacation.
- Balance: The balance request form is usually issued at least ten weeks before the departure date. The balance must not be received later than the stated balance due date. Failure to pay the balance does not indicate your intention to cancel your booking, which must be done in writing (see cancellation section below). If you do not pay the full amount within the specified period, Nar-Club reserves the right to treat this as a cancellation and will write to you to confirm this in such cases. In such cases, you will forfeit the deposit paid and will be liable to pay all cancellation fees charged by the tour operator and Nar-Club’s cancellation fee of €50.00.
Reservation Confirmation
All payments received by Nar-Club at its office for deposits, interim payments and balances will be confirmed to you in writing by email if possible, otherwise by post. A final participation package including tickets, room lists and other additional information will be given to you approximately ten days before your departure.
Cancellations
Cancellation by Members
If you do not pay the full amount of the holiday or cancel the holiday, you will be liable to pay the deposit paid (even if the tour operator’s booking conditions stipulate otherwise) and any cancellation fees imposed by the tour operator on Nar-Club. The tour operator’s cancellation fees are set out in the tour operator’s booking conditions online and in relation to each holiday, copies of which are available on request. All cancellations must be sent in writing (by email or post). Nar-Club will respond to your notice of cancellation and you should consider yourself booked for the vacation until you receive written confirmation of your cancellation. Failure to contact you or failure to pay the balance will not be considered notice of cancellation.
Cancel by Nar-Club
Nar-Club has to cancel reservations from time to time. The main reasons for this are that the tour operator cancels the holiday or the holiday is canceled due to not reaching the required number of reservations. Nar-Club reserves the right to cancel the holiday at any time in the event that the tour operator cancels the holiday in accordance with the tour operator’s booking conditions (“tour operator’s booking conditions”) as set out in the tour operator’s brochure or on the tour operator’s website. Nar-Club also reserves the right to cancel the holiday at any time up to two months prior to the departure date due to non-booking by Nar-Club members. In such cases, if Nar-Club cancels, Nar-Club will offer an alternative vacation if possible or refund all monies paid by you, but Nar-Club will incur no further liability.
Non-Members and Former Members
Nar-Club is a membership organization and all holidays are offered as a membership benefit only. To be able to travel on a trip, you must be a Nar-Club member at the time of booking the vacation.
Variations
Nar-Club will endeavor, as far as possible, to ensure that Nar-Club and the tour operator do not make significant changes to the main elements of the booked holiday. Except for the acts or omissions of persons providing transportation in connection with the holiday for which Nar-Club cannot be responsible, it may sometimes be necessary for the tour operator to make significant changes to the holiday. In the event that a tour operator makes a significant change to the main elements of the holiday, Nar-Club will reimburse you for liquidated damages received by Nar-Club from the tour operator in accordance with the tour operator’s booking conditions. Until the last date of the holiday, you may inform Nar-Club that you wish to transfer your booking to another Nar-Club member of the same gender (required for accommodation) who fulfills all the conditions applicable to the holiday. When notifying Nar-Club that you wish to transfer your vacation, you must include a written notification from the Nar-Club member to whom you wish to transfer the vacation that they accept the transfer of the vacation. In the event that the Nar-Club member to whom you wish to transfer the holiday does not pay the full price of the holiday, you will remain liable to pay the full price of the holiday and will also be liable to pay Nar-Club any fees charged by Nar-Club or the tour operator for the transfer of the holiday. You or the Nar-Club member to whom you wish to transfer the holiday must pay all costs of the holiday plus any transfer fees charged by the tour operator and Nar-Club’s reasonable transfer fee (to cover administration costs) before the transfer can take place. Any notice given under this condition will be deemed to have been received by Nar-Club upon receipt of the notice at the Nar-Club office. In some cases, it may not be possible to transfer airline tickets. In this case, an additional amount for the replacement airfare will be paid by the Nar-Club member to whom you are transferring. In the event that the Nar-Club member you wish to transfer the vacation to does not pay the full price of the ticket, you will be responsible for this cost. In some cases, airlines may make changes to aircraft type, timing and airports. Nar-Club or the tour operator will notify you of such changes as soon as possible, but cannot accept any liability for such changes.
Additional Costs
Nar-Club reserves the right to change prices as a result of surcharges detailed in the tour operator’s booking conditions. If the surcharges received exceed a certain limit specified in the tour operator’s booking conditions, Nar-Club may cancel a holiday under those booking conditions and receive a full refund for that holiday, Nar-Club will refund all monies received from the tour operator in the event that you cancel your holiday as a result of the receipt of such surcharges.
Health and Insurance
Insurance coverage is mandatory for all vacations offered by Nar-Club. Nar-Club is not responsible for any medical expenses incurred by you or for any loss, damage or expense incurred by you as a result of injury or illness. Please consult your doctor for advice on vaccinations and immunizations before departure. Nar-Club cannot be held liable for cancellation costs and any penalties or other damages incurred as a result of not receiving the required vaccinations and immunizations will be borne by the member.
Visas & Passports
It is your responsibility to ensure that you have an appropriate and up-to-date passport and the necessary visas for your vacation. Nar-Club cannot be held responsible for cancellation costs and any resulting fines or other damages will be borne by the member if they are not sure that they have the necessary travel documents.
Grievance Procedure
If you have a complaint about your holiday arrangements, you should report it to your Nar-Club holiday coordinator or a representative of your local tour operator as soon as possible. If you make a complaint after returning from vacation, you must notify Nar-Club ten days before the date by which any notice of complaint must reach the tour operator in accordance with the tour operator’s booking conditions. Failure to make a complaint on the spot may result in the reduction or elimination of any compensation to which you may otherwise be entitled. If you receive a complaint, Nar-Club will use reasonable endeavors to assist you in submitting your complaint to the tour operator, but Nar-Club will not be liable or responsible to compensate you for any matter on which your complaint is based. Nar-Club will reimburse you for any monies received by Nar-Club from the tour operator as a result of your complaint to the tour operator.
Emergency Contact Person
In case of an emergency during your Nar-Club vacation, you should first contact the Nar-Club vacation coordinator or your local tour operator’s representative. Otherwise, please contact Nar-Club on +90 545 638 3434.
Luggage and Personal Belongings
Nar-Club will not be responsible for any loss or damage to baggage, personal belongings, money or documents.
Security for Toll Coins and Registration
Deposits and prepayments are secured by depositing them in a designated escrow account. The escrow account also holds funds to ensure repayment in the event of bankruptcy of Nar-Club members.
Responsibilities
Where you do not suffer any personal loss, Nar-Club accepts no responsibility and will not be liable to compensate you for any loss or damage (including both direct and indirect losses and loss of enjoyment) if any of the holiday arrangements booked with Nar-Club are not provided as described in the Nar-Club holiday information sheet or the tour operator’s brochure. Except that Nar-Club will use reasonable endeavors to assist you in making a complaint to the tour operator in accordance with our complaints procedure section. Nar-Club will not be liable to compensate you for your inability to enjoy your holiday arrangements if the failure to fulfill your holiday arrangements is your fault or could not have been foreseen or prevented by Nar-Club, the tour operator or the tour operator’s suppliers, or if the failure to fulfill the holiday arrangements is due to the actions of someone unrelated to the holiday arrangements. In no event will Nar-Club’s obligation to compensate you for any loss or damage (including both direct and indirect losses and loss of enjoyment) exceed the tour operator’s obligation to compensate you for loss and damage as set out in the booking conditions. In the event of death or injury to you or your guests as a result of an activity that is part of the holiday arrangements, Nar-Club will be liable to compensate you or your guests if the death or injury suffered by you or your guests was caused by the negligence of Nar-Club or a Nar-Club holiday coordinator. Nar-Club will not be liable to compensate you or your guests for death or personal injury caused by the negligent act or omission of any person, including the tour operator, its employees, contractors and suppliers. Assuming that Nar-Club is liable to pay compensation to its members, members are obligated to fully assist Nar-Club in collecting any sums that Nar-Club may seek to collect from any third party, including but not limited to the tour operator, hotel and airline.
Holiday Participation
When you book a Nar-Club vacation, you accept the authority and judgment of the Nar-Club vacation coordinator and any other tour leaders and agents appointed by Nar-Club or a tour operator who accompany your party while on vacation with Nar-Club. If, in the opinion of such person, the health or conduct of any Nar-Club member before or after departure is likely to endanger the safety of himself or herself or others, the Nar-Club member endangering the party may be excluded for all or any part of the tour.
Laws
This agreement, including all matters arising out of this agreement, shall be governed by French Law and the exclusive jurisdiction of the Turkish Courts.
